These Terms and Conditions of Use (hereinafter referred to as "Terms") establish the legal framework for providing the Astraeus application and define the conditions for accessing and using the services by the user (hereinafter referred to as "User").

These Terms are accessible within the application under the "Terms" section.

Registration or use of the Astraeus application implies the User's unconditional acceptance of these Terms.

Astraeus reserves the right to unilaterally modify these Terms at any time.

Article 1: Legal Notices

The Astraeus application is published by the Individual Enterprise (EI) PORT Clément, operating under the commercial name P&GT Technologies, registered with the National Register of Enterprises (RNE) under number 940 694 441.

Article 2: Application Content

2.1 Nature of the Service

The application provides a platform for displaying astronomical events such as meteor showers, eclipses, certain planetary views (conjunctions, elongations, etc.), and supermoons. A brief description of each event is provided, based on the work done by the Astraeus team. The User is solely responsible for the use and interpretation of the results and information presented on the site.

Each event can be added to the User's Google Calendar through an "Add to Calendar" button. Users log into their Google account via a secure OAuth 2.0 authentication process. The email address provided is verified by Google during authentication to ensure the User's identity. Only Users with verified accounts can link events to their Google Calendar. Non-registered Users may use the application but cannot link events to a Google Calendar.

2.2 Access to the Application

The Astraeus application is freely accessible to any User with an internet connection. All costs incurred to access the service (hardware, software, internet connection, etc.) are the User’s responsibility.

While the application is generally accessible at all times, EI PORT Clément reserves the right to:

No account creation or subscription is necessary to access the application.

2.3 Unsubscribing

There is no subscription required to access the application. Any registered User may request to unsubscribe by contacting support via email at support@pgt-technologies.com. The unsubscription will take effect within a reasonable timeframe.

2.4 Advertisements

The User accepts that advertisements, including those from third parties, may be displayed within the application.

Article 3: Privacy Policy

The Astraeus application does not collect or store personal data directly. Any personal information involved in the User linking events to their Google Calendar is processed solely by Google through the OAuth 2.0 authentication system. Astraeus has no access to, nor does it retain, this personal data.

3.1 Collection and Use of Personal Data

The application facilitates access to Google Calendar events via a secure OAuth 2.0 authentication process managed by Google. The User’s personal data (such as email address) entered during this process is not collected, stored, or controlled by Astraeus.

The User voluntarily provides their personal information to Google during authentication. Astraeus acts only as a gateway and does not process personal data beyond the scope of this authentication.

3.2 Data Storage and Retention

Since Astraeus does not collect or store personal data, it does not retain any such data. All personal data remains under the control and responsibility of Google, according to their privacy policies.

3.3 Third-Party Processing

Any personal data involved in calendar linking is processed exclusively by Google. Astraeus does not share, sell, or transfer personal data to third parties.

3.4 Security Measures

Astraeus ensures secure communication between the User and Google through standard OAuth 2.0 protocols but does not handle or store personal data itself. Users are encouraged to review Google's privacy policy for details on their data protection practices.

3.5 User Rights

As the application does not store personal data, Astraeus cannot directly modify or delete such data. Users should contact Google to exercise their rights regarding personal data associated with their Google account and OAuth 2.0 authentication.

3.6 User Rights and Complaints

Under applicable data protection laws, Users have the right to access, rectify, delete, restrict processing, withdraw consent at any time, and exercise data portability concerning their personal data.

Since Astraeus does not process or store personal data, Users should exercise these rights directly with Google regarding their Google account data. For any data processing inquiries related to Astraeus, Users may contact support@pgt-technologies.com.

If Users believe their data protection rights have not been respected after contacting Astraeus, they have the right to file a complaint with the French data protection authority (CNIL):

Article 4: Intellectual Property

The brands, logos, and signs of the Astraeus application, as well as original content developed specifically for the application (including texts and design), are protected under the Intellectual Property Code, mainly copyright.

The Astraeus brand is a registered trademark of EI PORT Clément. Any reproduction, representation, or exploitation in whole or in part of this brand, by any means, is strictly prohibited.

Users must obtain prior authorization from the application operator for any reproduction, publication, or copying of content produced by Astraeus. Usage of original content is strictly limited to private purposes; any commercial or advertising use is prohibited.

Any unauthorized reproduction or representation of the application’s protected content constitutes copyright infringement as defined by articles L335-2 and following of the Intellectual Property Code.

In accordance with article L122-5 of the Intellectual Property Code, Users reproducing or publishing protected content must cite the author and source.

Some astronomical predictions accessible in the Astraeus application are based on publicly available data from NASA. Permission is freely granted by NASA to reuse this data, provided the following acknowledgment is included:
“Eclipse Predictions by Fred Espenak, NASA/GSFC Emeritus”.

Images used in the Astraeus application are sourced from free image providers or are freely available images from the Internet. If you believe any image is improperly attributed or should not appear, please contact EI PORT Clément for rectification or removal.

Article 5: Liability

The sources of information disseminated on the Astraeus application are considered reliable; however, the application cannot guarantee the absence of defects, errors, or omissions.

Information is provided for general informational purposes only and holds no contractual value. Despite regular updates, Astraeus cannot be held liable for changes in administrative or legal provisions after publication, nor for the use or interpretation of information on the site.

Users are responsible for maintaining the confidentiality of their passwords. Disclosure of passwords is prohibited, and Users assume all risks associated with their use. Astraeus disclaims all liability in this regard.

Astraeus cannot be held responsible for viruses that may infect the User’s computer or equipment as a result of accessing or downloading content from the application.

Liability is excluded in cases of force majeure or third-party acts that are unforeseeable and insurmountable.

Finally, Astraeus declines responsibility for disputes between Users.

Article 6: Hypertext Links

Hyperlinks may be present on the application with the prior authorization of EI PORT Clément. Users are informed that clicking these links will redirect them outside of the Astraeus application.

EI PORT Clément has no control over linked sites and therefore assumes no responsibility for their content.

In particular, the Astraeus application may provide hyperlinks to relevant Wikipedia pages to provide additional information and explanations for users. No Wikipedia text or data is reproduced in the application; these links are offered solely as references for further reading.

Establishing any hyperlink to all or part of the application is strictly prohibited without prior written authorization from EI PORT Clément. Such authorization may be refused without justification.

If granted, the authorization is temporary and may be withdrawn at any time without notice.

Article 7: Interferences

Users must not use any mechanism, tool, software, or procedure that could negatively affect the operation of our facilities, the security of the Internet, or other Internet users. Overloading our servers with automated requests or assisting third parties in such actions is prohibited.

Users are not authorized to modify, disassemble, decompile, or reverse engineer the application in any way. Moreover, the unauthorized use, integration, aggregation, or reproduction of the application content without express consent from EI PORT Clément is prohibited.

Article 8: Cookies

Users are informed that during visits to the application, cookies may be automatically installed on their browser.

Cookies are small files temporarily stored on the User's device by the browser and are necessary for the proper functioning of the Astraeus application. Cookies do not contain personal identifying information but contain a unique, randomly generated anonymous identifier. Some cookies expire after the session, while others remain.

By using the application, Users consent to the use of cookies. Users can deactivate cookies through their browser settings.

Article 9: Applicable Law and Jurisdiction

These Terms are governed by French law. In the absence of an amicable resolution, disputes arising between the parties shall be subject exclusively to the jurisdiction of French courts.
